Arizona state law regarding DUI:
Misdemeanor DUI offenses:
If you are in actual physical control of a vehicle and are impaired to the slightest degree by the use of intoxicating liquor, any drug, a vapor releasing substance containing a toxic substance or any combination of these things you will be charged with DUI. You may receive a second DUI citation if you have a blood alcohol content (BAC) of .08 or above within two hours of driving or being in actual physical control of a vehicle. If you are driving a commercial vehicle you will receive a DUI if you have any drug or it's metabolite in your system or if you have a BAC of .04 or above. You can receive a third DUI called an Extreme DUI if you are in actual physical control of a vehicle with a BAC of .15 or higher.
Felony DUI offenses:
You can receive an aggravated DUI if you are driving under the influence with a license that has been canceled, suspended, revoked or refused as a result of a previous DUI. You can receive an aggravated DUI if you commit a third subsequent offense within a 60 months (5 years) time period. You can receive an aggravated DUI if you are driving under the influence with a person under 15 years of age in the vehicle. This offense can also result in charges of Child Endangerment and/or Child Abuse.
Underage DUI:
The state of Arizona has adopted a zero tolerance law for minors. If you are under the age of 21 and have any spirituous liquor in your body at all and are in actual physical control of a vehicle you will be charged with DUI and can also be charged with Minor in Consumption whether you are driving or not.
